These Terms of Service ("Terms") constitute a legally binding agreement between you ("Renter," "you," or "your") and Eminence Exotic Car Rental LLC("Company," "we," "us," or "our"), governing your use of our website located at EminenceRentals.com(the "Site") and all exotic vehicle rental services provided by the Company (collectively, the "Services").
PLEASE READ THESE TERMS CAREFULLY BEFORE USING OUR SERVICES. BY ACCESSING OR USING THE SITE OR SERVICES, YOU AGREE TO BE BOUND BY THESE TERMS. IF YOU DO NOT AGREE TO THESE TERMS, YOU MUST NOT ACCESS OR USE OUR SERVICES.
1. Acceptance of Terms
1.1 By accessing, browsing, or using the Site or Services, you represent and warrant that you have read, understood, and agree to be bound by these Terms, our Privacy Policy, and any additional terms and conditions referenced herein.
1.2 We reserve the right to modify these Terms at any time. Any modifications will be effective immediately upon posting on the Site. Your continued use of the Services following the posting of revised Terms constitutes your acceptance of such modifications.
1.3 Certain features of the Services may be subject to additional terms and conditions, including the Rental Waiver and Liability Release Agreement. Such additional terms are incorporated by reference into these Terms.
2. Eligibility Requirements
2.1 Minimum Age. The primary renter must be at least twenty-five (25) years of age at the time of rental. Drivers between the ages of eighteen (18) and twenty-four (24) may be eligible to rent subject to payment of a Young Driver Surcharge of $500 per rental period and at the sole discretion of the Company.
2.2 Valid Driver's License.You must possess a valid, unexpired driver's license issued by a U.S. state or territory, or a valid international driver's license accompanied by a valid passport. Temporary, learner's, or restricted licenses are not accepted.
2.3 Insurance. You must maintain, at your own expense, a valid automobile liability insurance policy that provides comprehensive and collision coverage for the rental vehicle. Proof of insurance must be presented at the time of vehicle pickup and must name Eminence Exotic Car Rental LLC as an additional insured or interested party during the rental period.
2.4 Identity Verification.All renters must present a valid driver's license and proof of insurance at the time of vehicle delivery. Our staff will verify your identity in person. Failure to present valid documentation will result in cancellation of the reservation without refund.
2.5 Reservation Approval. All reservations are subject to approval by the Company at its sole discretion. We reserve the right to refuse service to any individual for any lawful reason.
3. Rental Terms and Conditions
3.1 Rental Period. The rental period begins at the time of vehicle pickup or delivery and ends at the scheduled return time as specified in the reservation confirmation. All rental periods are calculated in twenty-four (24) hour increments.
3.2 Vehicle Pickup and Return. Unless delivery service has been arranged, the vehicle shall be delivered and picked up within the Greater Seattle Area. Delivery and pickup services are available within fifty (50) miles of Seattle at no additional charge.
3.3 Vehicle Condition. The renter shall receive the vehicle in clean, mechanically sound condition with a full tank of fuel. The renter must return the vehicle in the same condition, with a full tank of fuel. The renter is responsible for inspecting the vehicle at the time of pickup and reporting any pre-existing damage.
3.4 Geographic Restrictions. Vehicle must stay within WA, OR, ID, or BC without prior approval. Unauthorized removal of the vehicle from the permitted travel area constitutes a material breach of these Terms and may result in immediate termination of the rental, repossession of the vehicle, and forfeiture of all deposits and fees paid.
4. Pricing and Payment
4.1 Daily Rate. The base daily rental rate is $1,200 per day, unless otherwise specified for a particular vehicle. All rates are quoted in U.S. dollars and are subject to applicable taxes and fees, including Washington State rental car tax.
4.2 Payment. Full payment for the rental period is due at the time of booking confirmation. All payments are processed securely through Peek Pro. We accept major credit cards. Debit cards and cash are not accepted.
4.3 Non-Refundable. ALL RENTAL PAYMENTS ARE NON-REFUNDABLE. This includes, without limitation, cancellations for any reason, early returns, no-shows, and weather-related cancellations. There are no exceptions to this policy unless the Company cancels the reservation (see Section 7.2). By completing your booking, you acknowledge and agree to this non-refundable policy. This disclosure is made in compliance with Washington State consumer protection requirements.
4.4 Security Deposit. The Company may place a temporary authorization hold on your credit card as a security deposit. This hold will be released within seven (7) to fourteen (14) business days following the satisfactory return of the vehicle, subject to inspection for damage.
5. Mileage Policy
5.1 Each rental includes 150 miles per day of the rental period. Unused daily mileage allowances do not carry over or accumulate across rental days.
5.2 Mileage in excess of the daily allowance will be charged at a rate of $4.00 per mile. Excess mileage charges will be assessed at the time of vehicle return and charged to the credit card on file.
5.3 The odometer reading will be recorded at the time of vehicle pickup and return. The renter acknowledges that the odometer reading at return constitutes conclusive evidence of miles driven.
6. Late Returns
6.1 The vehicle must be returned by the date and time specified in the reservation confirmation. Late returns will be assessed a fee of $100 per hour, calculated from the scheduled return time.
6.2 A late return exceeding four (4) hours will be charged as an additional full rental day at the applicable daily rate.
6.3 Failure to return the vehicle within twenty-four (24) hours of the scheduled return time without prior authorization from the Company may be treated as unauthorized possession of the vehicle and reported to law enforcement authorities.
7. Prohibited Uses
7.1 The renter shall not, and shall not permit any other person to, use or operate the vehicle for any of the following purposes:
- Racing, speed testing, or participation in any motorsport event, rally, or competition;
- Towing or pushing any vehicle, trailer, or other object;
- Transporting passengers or goods for hire (including ride-sharing, delivery, or livery services);
- Carrying any load exceeding the vehicle's rated capacity;
- Operating the vehicle while under the influence of alcohol, drugs, or any intoxicating substance;
- Operating the vehicle in violation of any applicable law, statute, ordinance, or regulation;
- Subleasing, subletting, or transferring possession of the vehicle to any third party;
- Operating the vehicle on unpaved roads, off-road trails, or surfaces not intended for normal vehicular traffic;
- Smoking, vaping, or use of any tobacco or cannabis products inside the vehicle;
- Transporting animals of any kind inside the vehicle without prior written authorization;
- Operating the vehicle outside the authorized geographic area as set forth in Section 3.4;
- Using the vehicle for any illegal or unlawful purpose;
- Allowing any person not listed on the rental agreement to operate the vehicle.
7.2 Violation of any prohibited use provision shall constitute a material breach of these Terms and shall result in immediate termination of the rental, repossession of the vehicle, forfeiture of all deposits, and the renter's liability for all resulting damages and costs.
8. Liability and Insurance
8.1 Renter's Liability. The renter is responsible for all damage to, loss of, or theft of the vehicle during the rental period, regardless of fault, including but not limited to: collision damage, vandalism, weather-related damage, tire damage, windshield damage, and interior damage.
8.2 Insurance Requirement.The renter's personal automobile insurance policy shall serve as the primary insurance coverage for the rental vehicle. The renter is solely responsible for filing all insurance claims and for payment of any applicable deductibles.
8.3 Diminished Value. In addition to repair costs, the renter may be held responsible for the diminished value of the vehicle resulting from any damage sustained during the rental period, as determined by an independent appraiser.
9. Limitation of Liability
9.1 TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, EMINENCE EXOTIC CAR RENTAL LLC, ITS OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, AND AFFILIATES SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, LOSS OF DATA, LOSS OF USE, OR BUSINESS INTERRUPTION, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE SERVICES OR THE RENTAL OF ANY VEHICLE, WHETHER BASED ON WARRANTY, CONTRACT, TORT (INCLUDING NEGLIGENCE), STRICT LIABILITY, OR ANY OTHER LEGAL THEORY.
9.2 THE COMPANY'S TOTAL AGGREGATE LIABILITY ARISING OUT OF OR IN CONNECTION WITH THESE TERMS OR THE SERVICES SHALL NOT EXCEED THE TOTAL AMOUNT PAID BY YOU FOR THE SPECIFIC RENTAL GIVING RISE TO THE CLAIM.
9.3 THE FOREGOING LIMITATIONS SHALL APPLY EVEN IF A REMEDY FAILS OF ITS ESSENTIAL PURPOSE AND TO THE FULLEST EXTENT PERMITTED BY LAW.
10. Indemnification
10.1 You agree to indemnify, defend, and hold harmless Eminence Exotic Car Rental LLC, its officers, directors, employees, agents, licensors, and affiliates from and against any and all claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees and court costs) arising out of or relating to:
- Your use of the Services or rental of any vehicle;
- Your breach of these Terms or any applicable law or regulation;
- Any damage to, loss of, or theft of the vehicle during the rental period;
- Any bodily injury, death, or property damage caused by or arising from your operation of the vehicle;
- Any claims by third parties arising from your use of the vehicle;
- Your negligence, willful misconduct, or violation of any prohibited use provision.
10.2 This indemnification obligation shall survive the termination of these Terms and the conclusion of the rental period.
11. Governing Law and Jurisdiction
11.1 These Terms shall be governed by and construed in accordance with the laws of the State of Washington, without regard to its conflict of laws principles.
11.2 Any legal action or proceeding arising out of or relating to these Terms or the Services shall be brought exclusively in the state or federal courts located in King County, Washington. You hereby irrevocably consent to the personal jurisdiction and venue of such courts.
11.3 The Company operates as a rental car business in compliance with all applicable Washington State statutes, including RCW Title 46 (Motor Vehicles), and all applicable federal, state, and local laws and regulations governing vehicle rental businesses.
12. Dispute Resolution
12.1 Informal Resolution. Prior to initiating any formal legal proceeding, you agree to first attempt to resolve any dispute, claim, or controversy arising out of or relating to these Terms by contacting us at info@eminencerentals.com. The parties shall negotiate in good faith for a period of thirty (30) days following receipt of written notice of the dispute.
12.2 Mediation. If the dispute cannot be resolved through informal negotiation within thirty (30) days, either party may submit the dispute to non-binding mediation administered by a mutually agreed-upon mediator in King County, Washington. The costs of mediation shall be shared equally between the parties.
12.3 Litigation. If the dispute is not resolved through mediation within sixty (60) days of the initial written notice, either party may pursue resolution through litigation in accordance with Section 11.2.
13. Modifications to Terms
13.1 We reserve the right to modify, amend, or update these Terms at any time and at our sole discretion. Any modifications will be effective immediately upon posting the revised Terms on the Site with an updated "Last Updated" date.
13.2 It is your responsibility to review these Terms periodically. Your continued use of the Services after any modifications constitutes your acceptance of the revised Terms.
13.3 We may, in our sole discretion, provide notice of material changes via email or a prominent notice on the Site. However, we are not obligated to do so, and the absence of such notice does not affect the enforceability of the modified Terms.
14. General Provisions
14.1 Entire Agreement. These Terms, together with the Privacy Policy, Rental Waiver, and any applicable reservation confirmation, constitute the entire agreement between you and the Company with respect to the subject matter hereof and supersede all prior or contemporaneous understandings, agreements, or communications.
14.2 Severability. If any provision of these Terms is held to be invalid, illegal, or unenforceable, the remaining provisions shall continue in full force and effect.
14.3 Waiver. The failure of the Company to exercise or enforce any right or provision of these Terms shall not constitute a waiver of such right or provision.
14.4 Assignment. You may not assign or transfer these Terms or your rights hereunder without the prior written consent of the Company. The Company may freely assign these Terms without restriction.
14.5 Force Majeure. The Company shall not be liable for any failure or delay in performance resulting from acts of God, natural disasters, pandemics, government actions, civil unrest, or other events beyond our reasonable control.
