RENTAL WAIVER AND LIABILITY RELEASE AGREEMENT
This Rental Waiver and Liability Release Agreement ("Agreement") is entered into between Eminence Exotic Car Rental LLC("Company," "we," "us," or "our"), operating in the Greater Seattle Area, WA, and the individual executing this Agreement ("Renter," "you," or "your").
BY EXECUTING THIS AGREEMENT, YOU ACKNOWLEDGE THAT YOU HAVE READ, UNDERSTOOD, AND VOLUNTARILY AGREE TO ALL TERMS AND CONDITIONS SET FORTH HEREIN. THIS AGREEMENT INCLUDES A RELEASE OF LIABILITY AND ASSUMPTION OF RISK. PLEASE READ CAREFULLY BEFORE SIGNING.
1. Assumption of Risk
1.1 You acknowledge and understand that the operation of a high-performance, exotic, or luxury vehicle involves inherent risks, including but not limited to: the risk of bodily injury, death, property damage, and emotional distress, to yourself and to third parties.
1.2 You understand that exotic and high-performance vehicles have unique handling characteristics, including higher horsepower, faster acceleration, wider turning radii, specialized braking systems, and performance-oriented suspensions that differ materially from standard passenger vehicles.
1.3 You voluntarily assume all risks associated with the rental and operation of the vehicle, including but not limited to risks arising from: road conditions, weather conditions, traffic conditions, mechanical failure, the actions of other motorists, and your own actions or omissions.
1.4 You represent and warrant that you are physically and mentally capable of safely operating the rented vehicle and that you possess sufficient driving experience and skill to operate a high-performance vehicle.
2. Release of Claims
2.1 To the maximum extent permitted by applicable law, you hereby release, discharge, and hold harmless Eminence Exotic Car Rental LLC, its owners, officers, directors, employees, agents, affiliates, successors, and assigns (collectively, the "Released Parties") from any and all claims, demands, actions, causes of action, suits, damages, losses, liabilities, costs, and expenses (including attorneys' fees) of any kind or nature, whether known or unknown, foreseen or unforeseen, arising out of or relating to:
- Your rental, possession, use, or operation of the vehicle;
- Any accident, collision, or incident involving the vehicle during the rental period;
- Any bodily injury, death, or property damage sustained by you or any third party;
- Any mechanical failure, defect, or malfunction of the vehicle;
- Any towing, impoundment, or citation related to the vehicle during the rental period;
- Any loss of personal property left in the vehicle.
2.2 This release applies regardless of whether the claims arise from the negligence (whether active or passive) of the Released Parties or from any other cause, except to the extent that such release is prohibited by applicable law.
2.3 You expressly waive any rights you may have under any statute or common law principle that would otherwise limit the scope of this release to claims known or suspected at the time of execution.
3. Insurance Requirements
3.1 You represent and warrant that you maintain a valid personal automobile liability insurance policy that provides, at minimum, comprehensive and collision coverage with limits sufficient to cover the full replacement value of the rented vehicle.
3.2 Your personal automobile insurance policy shall serve as the primary insurance for the rented vehicle during the rental period. You agree that any claim for damage, loss, or theft of the vehicle shall first be submitted to your personal insurance carrier.
3.3 You are solely responsible for all insurance deductibles, co-pays, and any amounts not covered by your insurance policy, including but not limited to the difference between the insurance settlement and the full cost of repair or replacement.
3.4 You agree to provide proof of valid insurance coverage at the time of vehicle pickup. Failure to provide satisfactory proof of insurance will result in cancellation of the rental without refund.
3.5 The Company does not provide insurance coverage for the rented vehicle. The Company's own insurance policy does not extend to or cover the renter, passengers, or third parties.
4. Vehicle Condition Acknowledgment
4.1 You acknowledge that you have had the opportunity to inspect the vehicle prior to accepting delivery and that you have received the vehicle in good mechanical condition, free from defects, and in a clean and well-maintained state.
4.2 A pre-rental vehicle condition report documenting the exterior and interior condition of the vehicle, including photographic evidence, shall be completed at the time of pickup. You agree to review and acknowledge the accuracy of this report.
4.3 Any pre-existing damage not documented on the vehicle condition report shall be presumed to have occurred during the rental period and shall be the renter's responsibility.
4.4 You agree to immediately report any mechanical issues, warning lights, unusual sounds, or performance concerns to the Company at (206) 981-7569. Continued operation of the vehicle after discovering a mechanical issue may result in additional liability.
5. Damage Responsibility
5.1 You are financially responsible for all damage to the vehicle occurring during the rental period, including but not limited to:
- Collision damage, regardless of fault;
- Single-vehicle accidents, including curb strikes, pothole damage, and road debris damage;
- Vandalism, theft, or attempted theft;
- Weather-related damage, including hail, flooding, and wind damage;
- Tire damage, including blowouts, punctures, and sidewall damage;
- Windshield and glass damage;
- Interior damage, including burns, stains, tears, and spills;
- Mechanical damage resulting from misuse, abuse, or improper operation;
- Damage to the undercarriage, including from speed bumps, road debris, or uneven surfaces.
5.2 In the event of damage, the renter shall be responsible for: (a) the full cost of repair or replacement, as determined by the Company; (b) loss-of-use damages for the period during which the vehicle is out of service for repairs; and (c) diminished value of the vehicle as determined by an independent appraisal.
5.3 You agree to pay any outstanding damage-related costs within fourteen (14) days of receipt of an invoice from the Company. Payment may be collected through the booking platform (Peek Pro) or via direct invoice. Failure to pay within the specified period may result in collection action and you shall be responsible for all associated costs, including reasonable attorneys' fees.
6. Fees and Surcharges
6.1 Cleaning Fee. A cleaning fee of $250 will be assessed if the vehicle is returned in a condition requiring cleaning beyond normal wear and tear. This includes, without limitation, excessive dirt, food or beverage spills, pet hair, sand, mud, or any foreign substances in the interior or exterior of the vehicle.
6.2 Smoking Fee. A fee of $500 will be assessed if any evidence of smoking, vaping, or use of tobacco or cannabis products is detected inside the vehicle. This fee covers the cost of professional ozone treatment, deep cleaning, and air purification necessary to restore the vehicle to its pre-rental condition.
6.3 Additional Driver Fee. Each additional authorized driver beyond the primary renter shall be subject to a fee of $250 per rental period. All additional drivers must meet the same eligibility requirements as the primary renter, including age, license, identity verification, and insurance requirements.
6.4 Young Driver Surcharge.Renters between the ages of eighteen (18) and twenty-four (24) who are approved to rent at the Company's sole discretion shall pay a Young Driver Surcharge of $500 per rental period. This surcharge is non-refundable and is in addition to all other applicable fees.
6.5 Late Return Fee. Late returns will be assessed a fee of $100 per hour, calculated from the scheduled return time. Returns exceeding four (4) hours past the scheduled return time will be charged as an additional full rental day.
6.6 Excess Mileage. Mileage in excess of the included 150 miles per day will be charged at a rate of $4.00 per mile.
6.7 Traffic Violations and Tolls. The renter is solely responsible for all traffic citations, parking violations, tolls, and other fines or charges incurred during the rental period. An administrative processing fee of $50 may be assessed for each violation that the Company is required to process.
7. Cancellation Policy
7.1 All rental payments are non-refundable. This policy applies to all cancellations, regardless of the reason, including but not limited to: changes in travel plans, weather conditions, illness, flight cancellations, or any other personal circumstance.
7.2 The Company reserves the right to cancel any reservation at its sole discretion. In the event that the Company cancels a reservation, the renter will receive a full refund of all amounts paid.
7.3 No-shows (failure to pick up the vehicle at the scheduled time without prior notice) will be treated as a cancellation and no refund will be issued.
7.4 Early returns do not entitle the renter to any refund, credit, or rate adjustment for unused rental days.
8. Roadside Assistance and Breakdowns
8.1 In the event of a mechanical breakdown or emergency not caused by the renter's negligence or misuse, contact the Company immediately at (206) 981-7569.
8.2 Do not attempt to repair the vehicle yourself or authorize any third-party repairs without express written consent from the Company. Unauthorized repairs may void the Company's warranty and result in additional charges to the renter.
8.3 If the vehicle becomes inoperable due to mechanical failure not caused by the renter, the Company will, at its sole discretion, either arrange for a replacement vehicle or issue a pro-rated credit for the remaining unused rental period.
9. Accident Procedures
9.1 In the event of any accident, collision, or incident involving the vehicle, you must:
- Immediately ensure the safety of all persons involved;
- Contact emergency services (911) if there are any injuries or if required by law;
- Contact the Company at (206) 981-7569 as soon as reasonably practicable;
- Obtain a police report and provide the report number to the Company;
- Exchange information with all other parties involved (name, contact, insurance, license plate);
- Document the scene with photographs, including all vehicles involved and the surrounding area;
- Do not admit fault or make any statements regarding liability to any third party;
- Cooperate fully with the Company, its insurance carriers, and law enforcement.
9.2 Failure to report an accident or comply with the procedures set forth above may result in additional liability and forfeiture of any applicable insurance coverage.
10. Governing Law
10.1 This Agreement shall be governed by and construed in accordance with the laws of the State of Washington, without regard to its conflict of laws principles.
10.2 The Company operates as a rental car business in compliance with all applicable Washington State statutes, including RCW Title 46 (Motor Vehicles), and all applicable federal, state, and local laws governing the rental of motor vehicles.
10.3 Any dispute arising out of or relating to this Agreement shall be subject to the exclusive jurisdiction of the state and federal courts located in King County, Washington. You irrevocably consent to the personal jurisdiction and venue of such courts.
10.4 If any provision of this Agreement is held to be invalid, illegal, or unenforceable by a court of competent jurisdiction, such invalidity shall not affect the enforceability of the remaining provisions, which shall continue in full force and effect.
11. GPS Tracking and Vehicle Monitoring
11.1 You acknowledge and consent that the vehicle may be equipped with GPS tracking and telematics devices that monitor and record: real-time vehicle location, mileage traveled, and geographic boundary compliance.
11.2 This monitoring is conducted solely for: vehicle security and theft recovery, enforcement of geographic restrictions set forth in this Agreement, compliance with mileage limitations, and insurance purposes.
11.3 Location data collected through GPS tracking is retained for ninety (90) days after the rental period ends and is handled in accordance with our Privacy Policy. Data may be shared with law enforcement in the event of theft, unauthorized use, or as required by law.
12. Identity Verification
12.1 Renter agrees to complete identity verification via the Company's verification partner within the booking period. Failure to complete identity verification at least twelve (12) hours prior to scheduled pickup will result in cancellation of the reservation and a full refund.
12.2 If identity verification fails due to document fraud, forgery, or a confirmed match on government sanctions or watchlists, the reservation will be cancelled and a full refund issued.
12.3 The Company may conduct media and public records screening as part of its verification process. Flagged results are reviewed individually by the Company. The Company will not automatically deny service based solely on media results and will make reasonable efforts to verify the accuracy and relevance of any flagged information before making a decision.
12.4 Renter acknowledges that payment confirms the reservation but does not guarantee vehicle delivery. Delivery is subject to successful completion of identity verification and insurance verification. If either verification fails, the reservation will be cancelled and a full refund issued.
13. Insurance Self-Reporting
13.1 Renter represents and warrants that all insurance information provided during the booking process is accurate and complete. Renter acknowledges that providing false or misleading insurance information constitutes a material breach of this Agreement and may result in cancellation, forfeiture of fees, and liability for any damages incurred.
13.2 Renter acknowledges that minimum $200,000 comprehensive and collision coverage is required for vehicle delivery. If coverage does not meet this minimum, Renter must either: (a) increase coverage through their insurer, (b) purchase supplemental coverage, or (c) agree to an increased security deposit, prior to vehicle delivery. Failure to resolve insurance requirements may result in cancellation and full refund.
14. Emergency Contact
14.1 Renter must provide a valid emergency contact (name and phone number) at the time of booking. The Company may contact the emergency contact in the event the Renter is unreachable during the rental period, in case of accident, or in case of overdue vehicle return.
15. Minimum Booking Window
15.1 All reservations must be made at least forty-eight (48) hours prior to the requested pickup time to allow for identity and insurance verification.
16. Electronic Signature Acknowledgment
11.1 By electronically signing this Agreement through our online booking platform, you acknowledge and agree that your electronic signature is the legal equivalent of your handwritten signature and shall have the same force and effect as a manually executed signature, pursuant to the Electronic Signatures in Global and National Commerce Act (E-SIGN Act, 15 U.S.C. § 7001 et seq.) and the Washington Uniform Electronic Transactions Act (RCW 1.80).
11.2 You represent and warrant that you are authorized to execute this Agreement and that the person executing this Agreement is the individual identified in the booking reservation and identity verification process.
11.3 You consent to the use of electronic records and signatures in connection with this Agreement and all related documents, notices, and communications.
17. Acknowledgment and Agreement
By executing this Agreement, you acknowledge and confirm that:
- You have read this entire Agreement and fully understand its terms, conditions, and implications;
- You voluntarily agree to assume all risks associated with the rental and operation of the vehicle;
- You release the Company and the Released Parties from all liability as described in Section 2;
- You have had the opportunity to consult with legal counsel before executing this Agreement;
- You meet all eligibility requirements, including age, license, insurance, and identity verification;
- You understand that all rental payments are non-refundable as described in Section 7;
- You understand and accept financial responsibility for all damage, fees, and surcharges described herein;
- You are not under the influence of any substance that would impair your ability to understand or execute this Agreement;
- This Agreement is binding upon you, your heirs, executors, administrators, and assigns.

This Rental Waiver and Liability Release Agreement is effective as of March 2026. By proceeding with your reservation and electronically signing this Agreement, you acknowledge that you have read, understood, and voluntarily agree to all terms and conditions set forth herein.
